Request for Further Evidence (RFE)

The USCIS often issue the request for extra details to authorize an individual’s I-526 petition. It can also be used in getting rid of EB-5 green card status. An interview or submitting extra documents may be required when filing for the RFE approval. It entails an immigration lawyer to get the application prepared before the interview. If the condition of not guaranteeing a favorable decision is reached due to insufficient evidence, it is better to contact the USCIS office. The simple meaning of an RFE is pointing out the items lacking in your application. With the RFE, applicants have enough time to provide extra details to the USCIS for consideration. The normal RFE will only verify lawfully obtained investment funds for any EB-5 Form I-526 application.

EB-5 Program Update:

The EB-5 Program has lapsed. The US Congress is discussing the legislation that authorizes the program while USCIS reviews the regulations and policies for filing. Because of the recent court ruling that reversed the 2019 Modernization regulations, the investment level has shifted temporarily from $900,000 back to $500,000.

If the program is reauthorized before the regulations are updated, there may be another window of opportunity to file at $500,000.

LCR expects the program to be reauthorized in December, and continues to work with international families that want to explore alternative residency options.
