AOS Mandamus Discussion

LCR is aware that some investors seeking an Adjustment of Status (AOS) at USCIS are experiencing significant delays. These delays are precluding some of our investors from working and/or traveling abroad. LCR reached out to some of the leading EB-5 attorneys to understand whether there were avenues that the investors could directly pursue to alleviate these delays. Through these discussions, LCR has been made aware of efforts being undertaken by some EB-5 attorneys to organize Writ of Mandamus filings for multiple similarly situated investors whose AOS processes are all similarly delayed by USCIS. It would appear that Investors who have been waiting for 6 months or longer for a completed AOS process may be eligible candidates to consider a Mandamus filing. In an effort to make you aware of this activity and to provide the best possible service we can, we are reaching out to determine whether there is interest among LCR investors to learn more about this process.

If you have had an AOS petition pending for 6 months or more, you may wish to consider joining a group filing to compel USCIS to take action on delayed petitions. LCR has organized this private webinar for clients that would like to learn more about the process, background on the issue, and what is involved from Rohit Kapuria of Saul, Ewing, Arnstein & Lehr (SEAL). SEAL has significant experience in these matters and together with Rohit, we would be happy to provide an opportunity to learn more. Of course, while we cannot speak to the legal processes nor ramifications of such Writ of Mandamus filings, our goal is to at least provide a platform where you can learn about the legal options to deal with such delays.
