Understanding and Navigating the EB-5 Visa Waitlist

The EB-5 Immigrant Investor Visa Program offers a path for foreign investors looking to gain US green cards by investment, but the visa waitlist and availability can be challenging to navigate. With demand for the EB-5 visa rising significantly since the EB-5 Reform and Integrity Act of 2022 (RIA) took effect, many prospective investors come to the process with uncertainty about processing time and waitlists. 

Processing times fluctuate frequently, and the waitlist can lead to significant delays for applicants, especially those from countries with high demand, such as China and India. To ensure a smoother experience, it’s useful to understand how the waitlist works and what factors contribute to these delays.  

How the EB-5 Visa Waitlist Works 

Due to high demand from certain countries, the EB-5 visa waitlist, or backlog, occurs when there are more approved applicants than visas available for a specific year. The United States allocates around 10,000 EB-5 visas annually, with individual countries receiving a maximum of 7% of these visas. Once a country reaches that 7% cap, applicants from that country are placed on the waitlist, leading to delays in visa processing. 

What Contributes to the Waitlist? 

Several factors contribute to the formation and length of the EB-5 visa backlog. 

Per-Country Cap. The United States has a yearly cap that prevents more than 7% of the total number of EB-5 visas from going to a single country—an approximate maximum of 700 per country. Once that limit is reached, applicants from that country are put on the waitlist. This cap is intended to prevent any single country from dominating the visa allocation, but it can lead to long delays for applicants from countries with high demand. This is especially challenging for applicants from high-demand countries like China and India. 

Family Member Visas. The visas granted to family members of EB-5 investors (spouse and children under age 21) count toward the annual limit of 10,000 visas. This means that a single application from an investor with a spouse and two children requires four visas, not just one, which further restricts the number of available visas. 

Priority Date and Final Action Date. The priority date is assigned when an investor files the I-526 petition, placing them in the queue for visa processing. When demand is high, the Visa Bulletin shows a “final action date,” meaning only those with a priority date earlier than the published date can move forward. If the priority date is later, investors remain on the waitlist. 

Visa Retrogression. Retrogression occurs when visa demand exceeds supply, causing the US Department of State to move the final action date back (earlier than the current date) in the Visa Bulletin. This affects investors whose petitions have already been approved but who now face additional delays due to limited visa availability. 

Managing the Backlog with Concurrent Filing 

For investors looking to manage the waitlist process most efficiently, concurrent filing is one strategy to consider. It allows investors who are already present in the United States on a valid non-immigrant visa, such as the H-1B, L-1, or F-1, to file their I-526 petition and adjust their status to receive the benefits of a green card holder while they are still waiting for their EB-5 petition to be approved.  

Concurrent filing is particularly helpful for investors from backlogged countries who might otherwise face significant delays, since it allows them to continue living, working, or studying in the US while their I-526 is processed. Many EB-5 investors find that this strategy simplifies their green card waiting process. 

Taking Advantage of Visa Set-Asides 

Another way EB-5 investors can minimize their waiting time is by exploring reserved visa categories, or visa set-asides. Visa set-asides are a special allocation of EB-5 visas reserved for specific investment categories that are less likely to face backlogs. The RIA introduced these set-asides to encourage investment in certain underserved areas in a way that benefits investors looking to gain their green cards faster. 

Each fiscal year, a portion of EB-5 visas is set aside for investments in three categories: 

  1. Rural Areas. 20% of total available EB-5 visas are reserved for investments made in rural areas. The US government defines these areas as having low population density, typically some distance from major metropolitan centers. 
  1. High Unemployment Areas. 10% of visas are set aside for investments in targeted employment areas (TEAs) with high unemployment. These regions suffer from job scarcity, and EB-5 investments in them aim to boost economic activity. 
  1. Infrastructure Projects. 2% of visas are reserved for investments in infrastructure projects, such as public works or facilities that improve essential services. 

Investors who make qualifying investments in these set-aside categories may be able to bypass the traditional visa backlog. These categories have priority processing and can accelerate the approval process for an I-526 petition. These set-asides provide an opportunity for applicants from high-demand countries to reduce their wait times significantly. 

A Path Forward for EB-5 Investors 

Though the EB-5 visa waitlist may seem daunting, the program offers various strategies to help investors overcome these challenges. By understanding how visa set-asides work and exploring options like concurrent filing, prospective investors can navigate the process more effectively and significantly reduce their wait times to enjoy the benefits that come with a green card. The flexibility built into the EB-5 program, especially with recent reforms, creates opportunities to bypass traditional backlogs and accelerate the path to US residency. 

Even though the road may require patience, the EB-5 program provides a viable and hopeful option for investors and their families seeking to make the United States their long-term home.
