The Path from EB-5 Visa to US Citizenship 

The EB5 Immigrant Investor Program is more than just a way to secure a visa; it’s a clear and certain pathway for foreign nationals and their families to achieve the ultimate goal of US citizenship. This journey is a deliberate, multi-stage process that, when successful, offers the stability and privileges of a lifelong legal status in the United States. 

Step 1: The Initial Investment and Conditional Residency 

The first stage of this transformative journey begins with a qualifying investment. An investor must commit capital to a new or existing US business that will directly or indirectly create at least 10 full-time jobs for US workers. The required investment amount is $800,000 for projects located in a Targeted Employment Area (TEA)—defined as either a high-unemployment or rural area—or $1,050,000 for projects in all other locations. 

Upon the approval of your I-526E petition by USCIS, you and your immediate family—your spouse and any unmarried children under the age of 21—are granted a conditional green card. This marks the beginning of a two-year conditional residency period in the US

Step 2: Removing the Conditions and Gaining Permanent Status 

The second phase is designed to prove that the investment has fulfilled its purpose. Before the two-year conditional residency period expires, you must file a Form I-829 petition. This filing provides evidence to USCIS that you have successfully met the program’s requirements, including sustaining your investment and creating the requisite number of jobs. 

Once this petition is approved, the conditions on your residency are removed, and you are granted a full, unconditional permanent resident green card. At this point, you and your family are considered lawful permanent residents, with all the rights and privileges that come with this status. 

Step 3: The Final Steps to Naturalization 

The final and most significant step is achieving US citizenship through naturalization. After holding your permanent green card for five years, you become eligible to apply. To qualify, you must meet specific requirements that demonstrate your commitment to your new country. These include being at least 18 years old, maintaining continuous physical presence in the US, demonstrating good moral character, and passing an English and civics test. 

Upon the successful completion of these requirements and participating in a final oath ceremony, you will become a US citizen. This grants you the ability to vote, hold a US passport, and removes the need for future green card renewals. It is the culmination of the EB5 journey, providing a lifelong, stable, and secure legal status in the United States.
