Indian professionals on H-1B visas are increasingly turning to the EB-5 investor visa program as employment-based green card wait times for Indian nationals now stretch 40-60 years. The shift follows the 2022 EB-5 Reform and Integrity Act, which allows applicants already in the US to file for adjustment of status concurrently with their EB-5 petition, granting work authorization and travel permission while their case is pending. Indian EB-5 filings have surged from 75 in FY22 to 1,902 in FY25, a 25x increase in three years, according to IIUSA data.
