The EB-5 Immigrant Investor Program offers a direct and reliable pathway for foreign nationals and their families to obtain a US Green Card by making a qualifying investment in a US business. Established by the US Congress, this program aims to stimulate the US economy through job creation. 

How the EB-5 Program Works 

The EB-5 visa is based on a straightforward principle: a foreign national invests a set amount of capital into a US commercial enterprise that creates or preserves at least 10 full-time jobs for qualified US workers. 

Key Requirements 

  • Investment Amount: The minimum investment amount is currently $800,000 for projects in a Targeted Employment Area (TEA)—a high-unemployment or rural area—or $1,050,000 for projects in other locations. 
  • Job Creation: The investment must lead to the creation of at least 10 full-time jobs for US workers within two years of the investor’s admission to the United States as a conditional resident. 
  • Source of Funds: All investment capital must be sourced from legal means and be fully traceable. 

The Path to Permanent Residency 

The EB-5 process is typically a multi-step journey: 

  1. I-526E Petition: The investor files a petition with USCIS to prove their investment and job creation plan meet the program’s requirements. 
  1. Conditional Residency: Upon approval, the investor and their qualifying family members (spouse and unmarried children under 21) are granted conditional permanent residency for two years. 
  1. I-829 Petition: After two years, the investor files a petition to remove the conditions on their residency by demonstrating that the jobs were created and the investment was sustained. 
  1. Unconditional Green Card: Once the I-829 petition is approved, the investor and their family are granted unconditional, permanent US residency. 

The Role of a Regional Center 

Most investors choose to participate in the program through an EB-5 regional center. These are entities designated by USCIS that manage EB-5 projects. They offer several advantages, including the ability to count both direct and indirect jobs towards the job creation requirement, which simplifies the process for the investor. The EB-5 Reform and Integrity Act of 2022 has also introduced new protections for investors, making the program more secure than ever before. 

For many families, the EB-5 program is a powerful and reliable way to gain a US Green Card, providing not only a new home but also the freedom to live, work, and educate their children anywhere in the United States.
