For over three decades, the United States has offered foreign investors a pathway to US residency that has proven transformative for thousands of families. The green-card-by-investment (EB-5 Visa Program) allows qualifying investors and their immediate families to obtain green cards in exchange for an investment that stimulates underserved American communities and creates domestic jobs.  

For families seeking greater opportunities in education or business or who want the ability to live and work anywhere in the United States, the EB-5 program provides a compelling avenue to achieve these goals. However, understanding the journey from application to permanent residency and eventual citizenship is essential for any EB-5 investor.  

The EB-5 Process: Key Timelines 

Initial Investment 

The EB-5 program requires investors to commit the necessary capital before or at the time of filing their I-526E petition. Ideally, you should deploy the full investment amount into the qualifying EB-5 project at the time you apply to ensure compliance with program requirements and to avoid potential delays. However, United States Citizen and Immigration Services (USCIS) does allow for partial investments under specific conditions, provided that you invest the full amount before your I-526E petition is adjudicated. The benefit of the partial investment option is the opportunity to secure an earlier priority date while you gather the rest of your funds.  

Filing the I-526E Petition 

The EB-5 journey begins with filing the I-526E petition, whose aim is to demonstrate your investment in a qualifying project and its potential to create at least 10 full-time jobs. Current processing times for the I-526E petition vary based on factors such as whether you are from a country subject to visa retrogression. On average, you should expect processing to take 24 to 36 months

What is visa retrogression? Visa retrogression occurs when the demand for green cards in a specific visa category or from certain countries exceeds the number of visas available in a given year. This excess leads to a backlog. For EB-5 applicants, this backlog means that individuals from countries with high application volumes—such as China, India, and Vietnam—may face additional delays in receiving a visa number even after USCIS has approved their I-526E petition. Working with experienced immigration professionals can help applicants strategize and navigate these delays, as well as choosing EB-5 projects that are given priority processing, such as those in rural and targeted employment areas (TEAs). 

Obtaining the Conditional Green Card 

Once the I-526E is approved, eligible applicants can either file for adjustment of status (if you are already in the US) or apply for an immigrant visa at a US consulate (if you are abroad). Adjustment of status (AOS) allows EB-5 applicants already in the US under a valid visa to receive work authorization and international travel authorization while waiting for their EB-5 petition to be adjudicated. Upon approval, you will receive a conditional green card valid for two years. This milestone allows you and your family to live, work, and study in the US, enjoying many of the same benefits as permanent residents.  

Filing the I-829 Petition 

Before your conditional green card expires, you must file the I-829 petition to remove conditions. This step demonstrates that your investment has met the EB-5 program’s requirements, including job creation and the maintenance of the invested capital “at risk” for at least two years. Processing times for the I-829 petition typically range from 24 to 48 months, although you can continue living and working in the US during this period under an extension of your residency status. 

Receiving the Permanent Green Card 

Upon I-829 approval, you will be issued a permanent green card (or “unconditional” green card) valid for 10 years, which grants full residency rights. This step completes the EB-5 immigration process, paving the way for you and your family to proceed toward US citizenship if you desire. 

Timeline to Return of Capital 

EB-5 investors can generally expect the return of their invested capital within three to five years of making the initial investment, depending on the project’s structure and financial performance. Most EB-5 projects outline exit strategies that align with the investor’s immigration timeline, ensuring compliance with USCIS requirements while facilitating the eventual return of funds. It is crucial for investors to thoroughly review the project’s terms and projected timelines before investing to set realistic expectations. 

Benefits of a Permanent Green Card 

Achieving permanent residency through the EB-5 program provides families with the stability to build a secure future in the United States. Unlike conditional residency, a permanent green card eliminates the need to renew your status or to continually demonstrate compliance with EB-5 requirements. It also offers a clear path to US citizenship, since permanent residents become eligible to apply for citizenship after five years, including the time spent under conditional residency. In addition, having a permanent green card unlocks a wealth of opportunities, granting you and your family access to the US job market, public benefits, and reduced in-state tuition rates at universities. These benefits make the permanent green card a transformative milestone for any EB-5 investor and their family.
