Indian investors pursuing a US Green Card through the EB-5 Regional Center Program have until September 30, 2026, to file Form I-526E if they want “grandfathering” protection under the 2022 EB-5 Reform and Integrity Act. This deadline does not mark the end of the EB-5 program. The Regional Center Program itself is authorized through September 30, 2027, but investors who file after the deadline would lose the specific protection against a future lapse in funding or authorization.
Suresh Rajan, Founder and Executive Chairman of LCR Capital Partners, told Financial Express Digital that USCIS needs to have the petition in hand by September 30. He advised investors to aim to send a complete I-526E “overnight on September 29 at the very latest.”
