In her recent publication, Shilpa Menon, Managing Director, Commercial at LCR Capital Partners, explains that most people familiar with the EB-5 Immigrant Investor Visa Program know the basics: invest in a US project, create American jobs, and receive a Green Card for yourself and your immediate family. Fewer people know that the 2022 EB-5 Reform Act added valuable protections for investors, including faster approvals for rural projects and adjustment of status, which allows applicants to receive a work permit and travel permit within months while their Green Card application is pending.
She notes that the grandfathering protection tied to these benefits expires on September 30, 2026, meaning applications filed afterward could lose the certainty of being judged under today’s rules. She adds that Indian families have particular reason to act soon, since the minimum EB-5 investment is expected to rise from $800,000 to roughly $930,000 to $940,000 once the January 2027 inflation adjustment takes effect.
